§ 2-207. Legal custodian.

  • (a)

    Town records.

    (1)

    Unless otherwise prohibited by law, or as designated herein, the town clerk-treasurer or his designee shall act as legal custodian for all town records, the town board and for any committees, commissions, boards or other authorities created by ordinance or resolution of the town board. In the event that the town clerk-treasurer is not available, then the town clerk-treasurer shall designate someone to act in his behalf as legal custodian.

    (2)

    This shall not include the records of the building inspection department whose custody is in the building inspector; the town assessment department whose records are in the custody of the town assessor; and the town fire department whose records are in the custody of the fire chief.

    (3)

    Records of the town fire department may be obtained by making a request, in writing, to the chief of the town fire department.

    (b)

    For every authority not specified in subsection (a) of this section, the authority's chief administrative officer is the legal custodian for the authority, but the officer may designate an employee of his staff to act as the legal custodian.

    (c)

    The legal custodian shall have full legal power to render decisions and to carry out the duties of an authority under Wis. Stats. ch. 19, subch. II (Wis. Stats. § 19.21 et seq.), and this article. The designation of a legal custodian does not affect the powers and duties of an authority under this section.
