Article III. ALL-TERRAIN VEHICLES AND OFF-ROAD MOTOR VEHICLE OPERATION |
§ 40-86. Restrictions on use of all-terrain vehicles.
(a)
State law adopted. The provisions relating to the use of all-terrain vehicles, as set forth in Wis. Stats. § 23.33, are hereby adopted and incorporated by reference.
(b)
Restrictions in residential areas. No all-terrain vehicle may be operated on private property which is zoned or intended to be used for residential purposes unless the parcel of property is ten acres or greater. The town board finds that the operation of all-terrain vehicles on parcels zoned or used for residential purposes, but consisting of less than ten acres, interferes with the use and enjoyment of adjoining properties used or zoned for residential purposes and, accordingly, must be restricted.
